By installing and using the Win Back Shopify application (the “App”), you (“Merchant”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, do not install or use the App. These Terms govern your access to and use of the App and form a legally binding agreement between you and Win Back Pty Ltd (“Win Back”, “we”, “our”).
Subject to your compliance with these Terms, Win Back grants you a limited, non‑exclusive, non‑transferable license to install and use the App solely for your own Shopify store. You may not resell, sublicense, reproduce or distribute the App.
You are responsible for the operation of your store and the content associated with your promotions. You agree to: (a) comply with all applicable laws and regulations, including consumer protection, competition and privacy laws; (b) obtain any required permits or approvals for your prize promotions; and (c) provide clear and transparent terms to your customers regarding the nature of each promotion and any eligibility criteria.
Win Back collects and processes customer data solely on your behalf to facilitate consent management and prize draws. We treat this data as confidential and do not use it for our own marketing purposes. You acknowledge that you are the controller of the data and must ensure that your collection of customer information complies with applicable data‑protection laws.
Some App features may require payment. Subscription fees are billed through Shopify and are subject to the billing terms provided by Shopify. Failure to pay applicable fees may result in suspension or termination of your access to the App.
The App is provided “as is” without warranties of any kind. Win Back does not guarantee that the App will be uninterrupted or error‑free. To the maximum extent permitted by law, Win Back will not be liable for any indirect, incidental, special or consequential damages, including lost profits, arising out of or in connection with your use of the App.
You agree to indemnify and hold harmless Win Back and its officers, directors, employees and agents from any claims, damages, liabilities and expenses arising out of your use of the App or your breach of these Terms.
We may terminate or suspend your access to the App at any time if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease.
We may modify these Terms at any time by posting an updated version on our website or through the Shopify App listing. Your continued use of the App after changes are posted constitutes your acceptance of the new Terms.
